4. Right of withdrawal
A legal person does not have the statutory 14-day right of withdrawal applicable to consumers.
A consumer has the right to withdraw from a distance contract within 14 days without giving a reason. In the case of goods, the withdrawal period generally begins when the consumer or a person designated by the consumer, other than the carrier, receives the goods.
The consumer may exercise the right of withdrawal by submitting an unequivocal withdrawal statement to office@tertkakao.ee or by using the withdrawal function available in the online store.
When exercising the right of withdrawal, the consumer must return the goods without undue delay and no later than 14 days after submitting the withdrawal statement.
The consumer bears the direct cost of returning the goods, unless the online store has agreed otherwise or has failed to inform the consumer in advance that the consumer is responsible for the return costs.
The online store will refund the payments received from the consumer, including the standard delivery cost paid for the original delivery, without undue delay and no later than 14 days after receiving the withdrawal statement. The online store may delay the refund until the returned goods have been received or the consumer has provided evidence that the goods have been returned, whichever occurs first.
The right of withdrawal does not apply in cases where an exception provided by law applies. This includes, among other things, goods that deteriorate or expire rapidly. Other statutory exceptions may also apply depending on the nature of the goods.
5. Defective goods and complaints
The online store is responsible for the non-conformity of goods with the terms of the sales contract where the non-conformity existed at the time of delivery.
For consumer sales, the online store is responsible for non-conformity that becomes apparent within two years from the delivery of the goods. If a non-conformity becomes apparent within the first year after delivery, it is presumed to have existed at the time of delivery unless the nature of the goods or the defect indicates otherwise or the online store proves otherwise.
The consumer should notify the online store of a defect as soon as possible and no later than two months after becoming aware of the defect.
Complaints can be submitted by e-mail to office@tertkakao.ee or by telephone at +372 58 770 600.
If the goods are defective and the online store is responsible for the defect, the consumer has the right to request that the goods be repaired or replaced. If repair or replacement is not possible, fails, or causes the consumer unreasonable inconvenience, the consumer may have the right to request a price reduction or withdraw from the sales contract in accordance with applicable law.
The online store will respond to a written complaint within 15 days. If the complaint cannot be resolved within that period, the online store will explain the reason for the delay and provide a reasonable additional deadline.
